MUZAFFARABAD: The Azad Jammu and Kashmir Supreme Court has affirmed the government’s position on the issue of refugee seats, rejecting the politics of protests, as stated in a recent press release. The court’s opinion on a presidential reference emphasized that the twelve refugee seats are constitutionally protected under Article 22 and cannot be altered by an administrative decision.
According to Radio Pakistan, the court further clarified that any changes to the refugee seats would require a constitutional amendment as stipulated under Article 33. The Supreme Court endorsed the government’s decision to delegate remaining constitutional matters to the elected Assembly, stressing that amendments should follow public mandate, parliamentary debate, and established constitutional procedures.
The court underscored the necessity of conducting elections on time under Article 22(4), noting that protests or political disputes should not obstruct this process. While affirming the right to peaceful protest, the court stated that actions such as blocking roads and disrupting daily life are not constitutionally protected. It highlighted that the exercise of individual rights should not infringe upon the rights of others, necessitating the administration to uphold public peace, constitutional order, and the rule of law.
Experts suggest that the AJK Supreme Court’s opinion strengthens the legal framework for action against those interfering with elections and state institutions.
