Indian Lawyers Call for Action Against Judge Over Alleged Anti-Muslim Remarks

New Delhi: Thirteen senior advocates have reached out to Chief Justice of India Sanjiv Khanna, urging immediate action against Justice Shekhar Kumar Yadav of the Allahabad High Court for his remarks against Muslims. The call comes after Justice Yadav reaffirmed his position, despite facing criticism for his statements.

According to a statement by Kashmir Media Service, the letter, signed by prominent Indian lawyers, denounces Justice Yadav’s speech at an event organized by the Vishwa Hindu Parishad (VHP) in December 2023. During the event, Yadav reportedly used derogatory language and made divisive comments about Muslims, questioning their ability to be “tolerant” and endorsing a majoritarian view of governance.

The advocates argue that Justice Yadav’s comments compromised judicial impartiality and spread hate instead of contributing to constructive dialogue. They express concern that his remarks violated constitutional provisions, including Articles 14, 21, 25, and 26, by insulting religious sentiments and fueling community enmity.

The letter to the Chief Justice calls for a suo moto notice and an investigation into Justice Yadav’s conduct. It recommends that the Central Bureau of Investigation (CBI) file an FIR against the judge for his statements. The advocates stress the importance of an impartial investigation, free from state influence, to maintain the judiciary’s integrity.
