IIOJK High Court Overturns Detention of Two Kashmiris Under Public Safety Act


Srinagar: In a significant legal decision, the High Court of Indian illegally occupied Jammu and Kashmir has annulled the detention of two Kashmiri individuals previously held under the Public Safety Act (PSA), ordering their immediate release unless required for other legal matters.



According to Kashmir Media Service, the ruling was handed down by Justice Sanjay Dhar of the High Court. The court specifically addressed the cases of Ghazi Ahmad Butt and Adil Fayaz Lone, whose detentions had been sanctioned by the District Magistrate of Shopian on different dates in late 2022. The justice highlighted procedural failures, including the authority’s failure to inform the detainees of their right to contest their detention, as key factors in the decision to overturn the orders.



The court’s directive emphasized the importance of legal process and the right to a fair trial, stating that any omission that compromises these principles could render such detention orders invalid. Consequently, both detainees are to be released immediately, assuming no other legal actions require their continued custody.
