IIOJK High Court Orders Release of Youth Detained Under Controversial PSA


Srinagar, In a significant legal decision, the High Court of Indian illegally occupied Jammu and Kashmir has ordered the release of Umar Aijaz Mir, a 27-year-old Kashmiri youth, who was detained under the controversial Public Safety Act (PSA) at Braily Jail in Uttar Pradesh, India.



According to Kashmir Media Service, Mir, who was arrested in 2022, had been implicated in six fake First Information Reports (FIRs) filed by the police in 2016. His counsel, Advocate Bashir Ahmed Tak, contended that the charges against Mir were baseless and unjust.



Judge Rahul Bharti, after reviewing the case and hearing the arguments, found the detention order issued by the District Magistrate of Bandipora to be illegal. Consequently, he directed that Umar Aijaz be released from detention, marking a notable judgment against the use of the PSA, often criticized as a “black law” for its controversial application.



The case highlights ongoing concerns regarding the application of the PSA in the region and the broader issue of legal rights and due process in Indian illegally occupied Jammu and Kashmir.
