Geneva, United Nations experts have praised the commitment of Iranian lawyers to the rule of law and their unwavering efforts to practice law independently and with integrity, despite facing significant challenges and dangers, particularly in the wake of the “Women, Life, Freedom” protests.
According to Office of the High Commissioner for Human Rights, the UN experts issued a statement ahead of the International Day of the Endangered Lawyer, highlighting the critical role played by lawyers in Iran amid recent protests following Jina Mahsa Amini’s death in police custody. Despite the risks, many lawyers have provided or attempted to provide legal assistance to protesters facing charges, facing intimidation, harassment, arbitrary arrest, and disbarment as a result.
The experts noted that the Iranian legal profession operates under perilous conditions due to government-imposed restrictions that contravene international standards for legal practice and fair trial rights. They pointed out the targeting of Iran’s historically independent Bar Association by the government through structural changes, regulations, and investigations.
Emphasizing the importance of a free legal profession to the rule of law, human rights, and an independent judiciary, the experts voiced concern about the impact on the right to a fair trial for all in Iran. They cited reports of detainees’ rights being breached, including the right to legal counsel of their choice and the right to consult with a lawyer, both crucial for due process.
The UN experts called on Iran to implement measures ensuring lawyers can fulfill their critical role in the legal system without facing prosecution, administrative, economic, or other sanctions for actions taken in line with professional duties, standards, and ethics.
