KARACHI: Mahfouzul Nabi Khan, a prominent civil society figure, has declared that a new standard of ethics has been introduced in the formation of the constitutional bench of the Supreme Court. He highlighted a significant concern regarding the self-nomination of an individual to head the bench and the involvement of the Attorney General in the process, which raises questions about the fulfillment of justice requirements, given the Attorney General’s role as the principal law officer of the federation obligated to follow the government in cases filed in the bench nominated by him.
According to Supreme Court of Pakistan, the process of forming the constitutional bench now includes lawyers from both the government and parliament, which Mahfouzul Nabi Khan argues is contrary to the principles of justice. He emphasized the importance of the collective wisdom of the full bench of the Supreme Court in explaining the constitution and the law, suggesting that the current approach may undermine this collective wisdom.
While speaking to others, Khan stressed the need for transparency and impartiality in the formation of the constitutional bench to ensure the integrity of the judicial process and uphold the principles of justice.
