Kashmir Conflict Intensifies with Indian Supreme Court Verdict, Claims Report

Karachi, A new report has highlighted the intensification of the Kashmir conflict following the Indian Supreme Court’s verdict on Article 370, viewing the decision as a furtherance of India’s controversial actions in the region since August 5, 2019. The report suggests that these actions and the court’s verdict are aimed at altering the demographic and cultural landscape of Occupied Jammu and Kashmir.

According to Kashmir Media Service, the report criticizes the Indian judiciary, particularly the Supreme Court, for decisions that align with the government’s stance on Kashmir, including the judicial killing of Afzal Guru Shaheed and responses to habeas corpus writs since August 2019. It alleges violations of both international law and India’s constitution, accusing India of malice in its actions towards Jammu and Kashmir.

The report outlines a series of steps taken by the Indian government, including the imposition of Governor’s rule, dissolution of the assembly, and the application of presidential rule, culminating in the change of Article 370. The Supreme Court’s decision is seen as not only contradicting the Indian Constitution but also as a mockery of justice.

Furthermore, the report discusses the legislation introduced by the Indian government on December 6, 2023, aiming to amend the Jammu and Kashmir Reorganisation Act, 2019, and the Jammu and Kashmir Reservation Act, 2004. These bills are perceived as further attempts to disempower the people of IIOJK and divide them based on language, area, and tribe.

The report emphasizes that the nature of the Kashmir dispute remains unchanged despite Indian actions and court decisions. It highlights that Kashmir is a longstanding unresolved issue on the United Nations’ agenda, with UNMOGIP deployed on both sides of the cease-fire line. It also notes that India’s actions violate United Nations resolutions on Jammu and Kashmir, particularly UNSC resolutions 91 (1951) and 122 (1957), and the 4th Geneva Convention of 1949.

The report calls on the international community to press India to engage with Pakistan and create a conducive environment for a plebiscite under UN auspices, emphasizing that the resolution of the Kashmir dispute in accordance with the will and wishes of its people is vital for sustainable peace and stability in the region.
