IIOJK High Court Overturns Detention of Three Kashmiris Under PSA


Srinagar, The High Court in Indian Illegally Occupied Jammu and Kashmir has nullified the detention of three Kashmiri men previously held under the Public Safety Act (PSA), marking a significant ruling against what has been described as the arbitrary application of this law.



According to Kashmir Media Service, the decision to overturn the detentions was led by Justice Rahul Bharti, who specifically addressed the case of Umar Nazir Rather from Tral. Rather’s detention was ordered by the District Magistrate of Pulwama based on allegations of his involvement in a scheme to distribute leaked examination papers. The court found that the actions attributed to Rather did not constitute a threat to public order, thereby rendering his detention under the PSA unjustified.



Similarly, Justice Puneet Gupta ordered the release of Ajaz Ahmed Peer from Baramulla and Inayat Rashid Bhat from Ganderbal, whose detentions under similar charges were also found to be unsubstantiated. The court mandated their immediate release unless they were required to be held for other legal matters.
