IIOJK Bar raises serious questions over Indian parliament’s Aug 5 decision

Srinagar, August 04, 2021 (PPI-OT): In Indian illegally occupied Jammu and Kashmir, the High Court Bar Association at a meeting presided over by its Chairman N.A. Ronga Advocate has unanimously declared that abrogation of Articles 370 and 35-A by Modi government is unconstitutional, undemocratic and in violation of the basic principles of political ethics.

The Bar Association said that the Indian parliamentary decision was against judicial propriety as the constitutionality of Article 370 is sub judice before the Supreme Court of India. It called upon New Delhi to revoke the 5th August 2019 action and restore Articles 370 and 35-A in its original form.

The Bar Association observed that the Indian government decision was against the basic principles of natural justice and established democratic principles besides being ultra vires to the constitutional framework and political will of the founding fathers of the Indian constitution.
