New Delhi, May 03, 2023 (PPI-OT): The Delhi High Court has issued a notice to the dreaded National Investigation Agency (NIA) on a plea moved by illegally detained senior APHC leader, Naeem Ahmad Khan, against a fake case registered by the agency. A division bench comprising justices Sidharth Mridul and Talwant Singh issued the notice to the agency and listed the matter on August 3, 2023 for hearing. Nayeem Khan has challenged the trial court order passed on March 16, 2023. The court will also hear the bail matter of Khan on the next date of hearing. He has challenged various charges framed against him under the black law Unlawful Activities (Prevention) Act (UAPA) and Indian Penal Code (IPC) in a false case of funding.
Nayeem Khan was arrested in July 2017.
It is submitted in the appeal that the prosecution has completely failed to substantiate any allegations related to the appellant’s affiliation or even any remote connection with any banned organisation, let alone any evidence to contend that the appellant was involved in the raising of the funds for an act. Earlier, Naeem Khan had challenged the order denying him bail. On December 22, the trial court refused to grant bail to Naeem Khan. The same dreaded NIA Court framed the fake charges against other APHC leaders including APHC chairman Masarat Alam, Shabbir Shah, Aftab Ahmad Shah, Ayaz Akbar, Raja Merajuddin Kalwal and Farooq Ahmed Dar alias Bitta Karate.
