AIMPLB Challenges Supreme Court’s Alimony Ruling for Muslim Women

New Delhi: The All India Muslim Personal Law Board (AIMPLB) has resolved to contest a recent Supreme Court decision regarding the maintenance rights of Muslim women post-divorce, declaring the judgment contrary to Islamic law.

According to Kashmir Media Service, the AIMPLB has empowered its president, Hazrat Maulana Khalid Saifullah Rahmani, to undertake all necessary legal, constitutional, and democratic actions to overturn the court’s verdict. The Supreme Court had ruled that a Muslim woman, divorced through the now-illegal “triple talaq” method, is entitled to seek maintenance under Section 125 of the Criminal Procedure Code (CrPC), a provision it described as “religion-neutral” and applicable to all married women regardless of personal law.

During a recent meeting, the AIMPLB argued that the verdict could exacerbate the difficulties faced by women already struggling with the consequences of divorce. The board also stated that requiring a man to maintain his ex-wife contradicts both divine injunctions and human reasoning, given the dissolution of the marital relationship.
